Sale of Property

Notarial Documents

These are documents of the highest order which by the Hague Commission are granted full credence by virtue of their intended use and attend to:

Notarial certification of ID, and other significant documents for use abroad and by your bank
Ante-nuptial (pre-marriage) contracts to prevent automatic merging of your separate estates and then facing upsetting consequences; structuring the contract, so as to protect your assets with the accrual system and ensuring fair distribution
Special and General Notarial Covering Bonds to place you ahead of ordinary creditors so that you do not land up with a mere concurrent claim (claim of the ordinary creditor) should your debtor become insolvent or about to lose his goods to the sheriff of court.

Rights of Unmarried Fathers

If you are an unmarried father, we have the solution for you. We can draft parental responsibilities and rights agreements and register them with the Family Advocate and/or make them orders of Court. We can defend against or launch applications on your behalf for custody, contact, care and guardianship.

Wills & Administration of Deceased Estates

I explain each aspect of what your Will should contain, and on death, what needs to be dealt with. I remove the trauma of complications which can arise (death of one who leaves no Will, called intestacy) and assist with the deceased’s assets, transfer of estate property and vehicles, time share, as well as all items of value.

I also discuss the deceased’s Trust set out in his Will and insurance policies which may not attract estate duty (death taxes).

Divorce & Family Law

Divorce by its very nature is stressful and traumatic. We assist in separating the wheat from the chaff (the essential good from the bad) and preventing unnecessary lengthy and costly proceedings whenever possible.

The need to continue with life and protect family after divorce is essential. As such, proper care is taken to allow emotional pouring out followed by pragmatic pursuit of your legal rights.

Protection Orders and Domestic Violence

If your partner commits any act of domestic violence against you, kindly contact us to assist you in applying for a protection order on your behalf. We also assist with opposing applications for protection orders and attend to counter domestic violence applications.

My Practice has acted over the years for large corporate clients, as well as small and medium businesses, in a range of disputes, which include round table meetings mediation and arbitration commercial concerning commercial agreements, claims arising out of goods sold and delivered, services rendered, breach of restraints of trade, employment contracts, claims for personal injury and patrimonial loss, divorce and claims arising from property transactions.

Injuries & Collision

If you or your loved one has been injured in a car accident, we will help you recover as much as is possible of what is due to you by Road accident Fund in regard to:

Medical Malpractice Claims

Should you/member of your family have suffered injury, loss of amenities, pain and suffering, bodily disfigurement, loss of earnings arising from medical negligence and/or mal-practice, we will pursue a claim for you against the appropriate medical body/ies or persons responsible.

Liquor licence applications

We attend to all such applications under the strict controls of the Liquor Licence Act and attend to its multitude of requirements with completion of documents, advertising, diagrams and all descriptions called for by the Act.

Debt Recovery

If someone owes you, your company or business money we can help. Letter of demand needed? Summons? We do it all.

Should the debt due to you not be paid after our letter of demand we will proceed with summons to obtain judgment and then attach goods to recover the amount owed to you including interest and costs.
We institute and defend all types of actions, both personal and corporate, whether for recovery of a debt arising from contract or by damages suffered (injuries by collision or accident, defamation vehicle damage) or other financial loss.

We appear in all the relevant Courts such as the High Court, Regional Court, and Magistrate’s court as well as arbitrations, mediations and CCMA appearances.

Maintenance Issues

If you are a single woman with children, the aspect of maintenance for the parent and the children should be properly addressed with regard to the protection afforded by the Maintenance Act and Children’s Act.

I will guide you so as to maximise the payment of your and your children’s maintenance, whilst considering the effects of the Consumer Price Index (concerning annual increase in interest).

Custody and Rights of Contact

We have extensive experience in drawing up parental responsibility and rights agreements, parenting plans and or joint residency agreements. Failing that, we will institute legal action to ensure that you obtain reasonable contact and/or custody. Injuries through Negligence of an Employee

This is a delictual claim (not one from contract) entitling the sufferer to claim for damages and losses as a result of the accident created by the negligence of the employee/owner of the business.
